High
Court taking into consideration the fact that the
Ejectment Execution Case No. 181 of 2011 has already
been stayed, allowed rent to be paid
occupation for a fixed term, can be ejected. Section 40 reads
as under:
“40. Grounds of ejectment of tenant for a fixed term—
A tenant ... procedure for ejectment, which is quoted hereinbelow:
“42. Restriction of Ejectment-A tenant shall not be ejected
otherwise that in execution of a decree
creates a bar against the passing or
execution of a decree or order for ejection. Section 5 reads as
under:-
“5. (1) No order
building or rented land shall
not be evicted therefrom in execution of a
decree passed before or after the
commencement of this Act or otherwise ... that Act expressly included “any person
against whom a suit for ejectment is pending
in a Court of competent jurisdiction” and
