suit for ejectment and rent was filed by the respondent, which was decreed exparte, thereafter the said decree was put in execution. The petitioner took
arrears of rent and ejectment was decreed with cost.
3. The Standing Counsel states that in the execution it has been recorded that the possession
which are being extensively argued, are quoted below:
"209. Ejectment of persons occupying land without title.-(1) A person taking or retaining possession ... asami without consent of the Gaon Sabha.
shall be liable to ejectment on the suit in cases referred to in Clause (a) above
orders, whereby the suit for arrears of rent and ejectment was decreed and the revision was dismissed.
3. As the findings of fact have been ... Constitution of India.
4. The petition is accordingly dismissed.
5. The execution proceedings shall proceed in accordance with the directions given by the Supreme Court
judgment and decree dated 02.09.2016 whereby, the decree of rent and ejectment was passed.
4. A perusal of the judgment and decree reveals that ... true, the same shall be placed before the Executing Court, if any, execution is filed.
5. In case there is no compromise, the Executing Court
proceedings against the respondent no.2 for arrears of land and ejectment.
3. It is stated that the Additional District Magistrate (Administration), Lucknow decided ... finally on 09.12.2024 (Annexure No.4). It is stated thereafter that an execution application was filed in which directions were issued on 26.05.2025 directing
objections under Section 47.
3. Admittedly the decree of rent and ejectment was passed on 20.09.2018, the same was never challenged and thus attained finality ... that it is well settled that decree cannot be gone into in execution proceedings, the objections were rightly rejected. No interference is called
