CAV JUDGMENT ... Corporation, which was admittedly an exempted establishment
under Section 17 of the EPF & MP Act, 1952 since January,
1987 to 31.03.2004 and as such
learned counsel for the petitioner fairly
submits that so far the remaining EPF amount is concerned, the
same has been paid to the petitioner ... petitioner is claiming statutory interest over the
delayed payment of EPF amount, which has been bestowed on
him, after a decade. He further contended that
rules each and every
employee of the BREDA is covered under the EPF scheme also
entitled to gratuity under the Payment of Gratuity
Therefore, once the order of the assessment has been set aside by
EPF Appellate Tribunal, vide its order dated 02.06.2011, the
retention of the money
being paid pension/family
pension under Employees Pension Scheme, 1995. The EPF
amount as has been deducted from the salary of the petitioners,
the same
petitioner prior to 1988 will have to be refunded by the EPF
Commissioner and for this a claim under Form
