while the medicine
sold by the Plaintiff is for treatment of erectile dysfunction in men, the
medicine being sold by the Defendant is a multivitamin
However, post surgery the
petitioner is suffering from urinary infection and erectile dysfunction for
which some advance treatment is required. Learned counsel submits that
taking
pharmaceutical
preparations, more particularly containing Sildenafil, which is used for
addressing erectile dysfunction. The prefix MAN of the Plaintiff's mark
MANFORCE has been
Prostatitis
(i.e. Swelling of the Prostate Gland in males), and Erectile Dysfunction (i.e.
impotency/sexual dysfunction in males), are treated by Urologist under
that the petitioner was
unable to perform sexual acts due to erectile dysfunction. The said report
has been placed on record and perused by this
potency test,' which notes a
history of erectile dysfunction, to support the contention that the Appellant
was physically incapable of committing the acts

any preparations/products falling in the category of erectile
