Commissioner of Police, Zone-IV, Ulhasnagar, District - Thane
dated 19th November ... present Writ Petition, the Petitioner has challenged
the externment order passed against him dated 07.09.2010 passed
by the Externing Authority - DCP, Zone-IV, Ulhasnagar, District
Raju were also present there. His
brother Shambhu was ordered for extern from Delhi. Accused Dheeraj, Lala,
Vikas @ Neta were the friends of his brother ... them for selling the stolen articles. His son Shambhu was
ordered for extern from Delhi. PW2 Udai Kant Jha has further deposed that
injuries were
found to be ante mortem in nature. During the external examination of the
body, the external injuries were also found on the dead ... Post
Mortem Report ExPW8/A are reproduced as under :
The external injuries found on the dead body are:
i) Bruise over left arm inner
about
4.10 pm, the accused was found within Delhi whereas the externment order has
been passed against him vide order no. 576141 Ext. Additional ... police officials. It is further argued that the
notice of externment was never served upon the accused and he was not in
knowledge
observed as
follows:
"The Doctor, after considering the findings as
regards external and internal injuries given opinion
as regards cause of death ... evidence of post mortem report and
the symptom; noticed by her on external and internal
examination, I find that the said evidence is

satisfactory

Sewa Singh. Since there was no obvious fatal injury visible externally on
the bodies of the deceased, the Board of doctors found it difficult ... effect that since there were no obvious fatal injuries visible externally on
the bodies of Baba Sewa Singh and Achhar Singh. It was difficult
conjunctival hemorrhage, whitish froth over mouth."
He found the following external injuries:
"1) Fresh abrasion over left side of face and chin ... lung deep obliquely.
No other external injury was found.
On dissection: 1) bruise over back side scalp. 2) meninges and
brain were markedly congested over
down and if that be true, obviously,
there would have been external injuries on that part of the
body of the victim. It is also ... accused to smother her. These acts
certainly would have caused external injuries and if that be
so, according to the learned counsel, it would have
course of
nature. This witness has further stated that there was no external
injury visible on the dead body. In the cross examination, this witness ... given detail of injuries:-
1. Alleged hit on skull. No visible external injury. X-ray and
surgical opinion sought.
2. Healed abrasion on and behind
complaining of pain in whole of the left side of
chest. Externally no visible injury sign seen. X-ray was
advised and injury was kept ... observation.
Gynae check up
Menopausal for 6 years. Breasts were normal. No
external injury was seen on genitalia. No internal mark of
Crl.Appeal
