2 The petitioner, herein has challenged the externment order
dated 18.4.2019 passed by the Deputy Commissioner of Police,
Circle-I, Aurangabad, confirmed ... Aurangabad vide order dated 18.10.2019 in File
No.2019/GA/POL I/Externment/CR-71.
3 Facts giving rise to this petition are as under
petitioner to show
cause as to why the petitioner should not be
externed from the Surat City and Surat Rural area
for the period ... show cause notice, the
Assistant Police Commissioner passed the order
dated 09.07.2019 externing the petitioner from
the entire area within the jurisdiction of
Police Commissioner
Single Judge in W.P.No.511/2019, whereby the order of externment dated
14-11-2018 and the order passed by the Appellate Authority ... hereinafter referred to
as 'Adhiniyam, 1990) has passed an order of externment of the appellant
from district Niwadi and its contiguous districts viz. Tikamgarh
under Sections 5 and 6 of the Adhiniyam, the District Magistrate has externed
the petitioner from entering into the District Sidhi and the contiguous districts ... proximity of the
offence committed by him to the order of externment. It is further submitted
that even otherwise the original order was passed

the alleged injured witnesses had sustained any
external injuries and all the alleged injuries were in
the form of tenderness ... none of the injured examined
by him had sustained any external injuries. All the
alleged injuries said to have been sustained by these
injured witnesses
informed about the quarrel. He has stated that
there was no external injuries on the person of
Rudrayya. He sent them to the hospital ... case
was closed.
23. In Ex.P9 there are no external injuries
noticed except the injured complaining of body
ache and chest pain. Therefore
Exhibit-P/37 reveals that the deceased had suffered following
injuries:-
"External Injuries-
1. Incised wound 4cm x 1½ cm x muscle deep ... Internal injuries on opening of body-
1. Sub. Scalp blood clots under external injuries nos. 1, 2 and
3.
2. Fracture of left temporal bone
done by PW2-Dr. Maroti Dake. He has stated
following injuries on external examination:
(i) Stitched incised wound present on head extending from frontal region ... apeal 707.15

have been caused by a sharp cutting instrument and that injury
