3. Thereafter, the Tribunal observed:-
"........... For the reasons recorded above ... granted in-situ promotion from the grade
of Scientist E to Scientist F under the FCS scheme; however, if he still
disagreed, he may appeal
that the modified ACP would also be applicable
to the scientists covered under FCS to provide an
alternative channel for development. Had there
been ... alternate channel for development for
Scientists and is expected to maintain the rigors of
assessment required for assessment under FCS.
Therefore the applicant

D and as per the Flexible Complementing Scheme (FCS), she
was eligible for promotion after 4 years
Complementing Scheme' (hereinafter referred to as FCS) that provided for
'in situ' promotions to Scientists. The scheme stipulated:
"* The minimum residency ... date of promotion of
the applicants under FCS Scheme for 'in situ' promotions for scientists.
13. By way of reply, the respondents have
that the modified ACP would also be
applicable to the scientists covered under FCS to provide an
alternative channel for development. Had there been ... alternate channel for development for Scientists
and is expected to maintain the rigors of assessment required
for assessment under FCS. Therefore the applicant
were working as Scientist-B to Scientist-G respectively.
Vide Notification dated 28.04.2008, the applicants were promoted
from Scientist-D to Scientist-F by respondent ... applicants were promoted
under Flexible Complementing Scheme(FCS) from Scientist-D (Pay
Band-3 with Grade Pay of Rs.7600/-) to Scientist-F (Pay Band
