Learned counsel for the petitioner has submitted that the
sample of fertilizer in the present case was drawn on 24.9.1996. Petitioner
was nominated ... whereas the sample was drawn much
earlier on 24.9.1996 and hence the petitioner cannot be held liable for
prosecution qua the said sample.
