provides for different Floor Space Indices for different areas in Greater
Bombay. Regulation 33 provides for Additional Floor Space Index that may
be allowed ... floor area of all floors,
excepting areas specifically exempted under the said
Regulations, to the total are of the plot, viz., floor space
index
respect of the flat.
4. The promoter hereby declares that the
Floor Space Index available in respect of
the said land is. ......... square metres only ... that no part of the said floor space
index has been utilized by the Promoter
elsewhere for any purpose whatsoever. In
case, the said floor
parameters specified in the table annexed to these rules.
(i) Floor Space Index (F.S.I.)
(ii) Height of building
(iii) Marginal open spaces ... above where open
spaces are not available in layouts, in
such cases Floor Space Index shall be
the75 per cent of the basic Floor Space
respect of the Flat.
4. The Promoter hereby declares that the Floor Space
Index available in respect of the said land is square
metres only ... that no part of the said floor space
index has been utilized by the Promoter elsewhere for
any purpose whatsoever. In case the said floor
petitioners had resorted to unauthorised construction and/or unauthorised utilisation of Floor Space Index (F.S.I.) in excess of that permitted under the sanctioned ... that an owner who was unable to consume the full authorised Floor Space Index (F.S.I.) on account of Heritage Regulations imposing restrictions
plots, layout plan, carpet areas, and utility areas of the flat, Floor Space Index or the Transfer of Development Rights or additional Floor Space Index ... number of sixty per cent. of total flats are sold, alongwith Floor Space Index consumed in such building, subject to the right of the promoter
Valuation of open land capable of utilising more
than 1 floor space index (F.S.I) or transfer of

development right ... rate of base value of open land with 1
floor space index, open land which is capable of
utilizing more than 1 floor space index
Plaintiffs, after the existing
buildings were constructed, potential of the
development/Floor Space Index as disclosed by Hiranandanis
was exhausted and a suit was filed ... buildings on the basis of TDR or
contending that development potential/Floor Space Index
has been fully exhausted. It has also been vehemently
urged that
petitioner is entitled to Transferable Development Rights (TDR) in
form of Floor Space Index for development of the Amenity Space in
terms of Clause ... recreational open space, shall be eligible
for the award of Transferable Development Rights (TDRs)
in the form of Floor Space Index
