decision to
implicate a person as an accused in the Fodder Scam Cases was taken at the
helm of the CBI i.e. the Director ... taken at the level of the Director, CBI in all the Fodder Scam cases
and in case of difference of opinion, on the basis

placed reliance upon the decision of the Apex Court in the case of
Sharad Hiru Kolambe (Supra) and Vicky Alias Vikas (Supra). It
however ... matters of suspension of sentence of such convicts under the
Fodder Scam cases such as, in R.C. Case Nos. 64(A)/1996
appellant /petitioner would prejudice not only the
case of the respondents, but also the case of other convicts and as

other fodder scam cases where his presence would be required at the
time of recording
