Forgery : [Whoever
makes any false documents or false electronic record or
part of a document or electronic record, with intent to cause
damage or injury ... document' with the definition of
'forgery', 'making a false document', if the text of the complaint is
tested, first
forgery by making a false document i.e. GPA, to cheat the
intended purchaser by making such false document, forgery of an
authority
which defines forgery, runs thus
"Whoever makes any false document or part of a
document with intent to cause damage or
injury ... established
before a fabricated document can be held to be a false
document or a forgery. In view of the terms of s. 463 what
follows:-
'463. Forgery- Whoever makes any falsed documents or false electronic record or part of a document or electronic record, with intent to cause ... defines.' forged document. Section 470 is quoted hereunder:-
'470. Forged document or electronic record- A false document or electronic record made wholly
false document. It says that a person is said to make a false document, who dishonestly or fraudulently makes, signs, seals or executes & document ... forgery and it reads as follows.
Whoever makes any false document or part of a document, with intent to cause dam-age or injury
make a false document-
First.-Who dishonestly or fraudulently makes, signs, seals or executes a document or part of a document, or makes any mark ... document.
A "forged document" is defined by Section 470 . Under that section " a false document made wholly or in part by forgery
books are false, due to this act the accused are liable for making false
documents, so the ingredients of the offence forgery as defined ... prosecution records would not bring the case of making false documents which
amounts to forgery, that after the criminal conspiracy entered into between the
accused
gave false evidence."
Section 196 deals with using evidence known to be false and
Section 199 deals with false statement made in declaration
which ... evidence which
he knows to be false or fabricated. Section 199 makes one
punishable for the offence of false statement made in a
declaration which
made any false document or part of a document and as such there can be no question of commission of forgery as has been defined ... making false document indicates that a person makes a false document if he signs a document or part of a document dishonestly or fraudulently with
