Indian Contract Act, 1872 defines "fraud" and
"misrepresentation" as follows:
"17. „Fraud‟ defined.--„Fraud‟ means and includes ... willingness of a person to enter into a contract is not
fraud, unless the circumstances of the case are such that,
regard being
competition laws;
(iii) insolvency/winding up;
(iv) bribery/corruption;
(v) fraud;
(vi) criminal matters.
Fraud is one such category spelled out by the decisions ... abuse of
position of confidence. The Black's Law Dictionary defines 'fraud' as a
concealment or false representation through a statement
contract, or with intent to commit fraud
or that the fraud may be committed, commits forgery.
Section 464 defining "making a false document ... gain advantage". Section 17 of the
Contract Act, 1872 defines `fraud' with reference to a
party to a contract. In Dr. Vimla
appeal, revision, writ or even in collateral proceedings.
17. The Court defined fraud as an act of deliberate deception with the design of securing something ... nunquam cohabitant), or fraud and deceit ought to benefit none (fraus et colus nemini patrocinari debent).

contended on behalf of the appellants that if fraud is allegedly committed
by the appellants in collusion with the issuer companies ... concept of "fraud" set out in the
PFUTP Regulations, 2003. The expression "fraud" is defined under the
PFUTP Regulations as follows
