submission that the pre-
emption application filed by the appellant
had to fail on account of subsequent
transfer by deed of gift would again require ... during the pendency of the pre-emption
application that the deed of gift was
registered on 27.06.2000 and thereafter, the
objection was raised by respondent
transaction, the pre-emption application
would not succeed with respect to the lands which
had been transferred by way of deed of gift before ... claim of pre-emption.
Learned counsel vehemently argued that
even before registration of the sale deed the aforesaid
deed of gift has been executed. However
basis of the claim
for the pre-emption, namely, the oral gift set up
by the pre-emptor vanishes, then the claim on the
