gravamen of the petition was that, the quarry
lease covered `Gomal' land and therefore, they ought to be
quashed. In this respect, reliance ... which inter alia noted the following
points:
"As areas of Gomal Lands wherein
Mining Leases (which) were granted
previously consist of huge and hard
pasturage for cattle in the village, contending inter alia
that it is gomal land. However, State on appearance
contended that some portions of gomal land ... made clear that if any portion of the
gomal lands in question is already granted or if
their occupation is regularized, such orders
activity going on in the said land and has
concluded that no gomal land is in possession of the
petitioner and the said lands ... going on in the said land. He
concluded that there is no Gomal land situated in these
survey numbers or in other words
noted herein above by reducing the extent of
gomal land which was to an extent of 103.30 acres by
exercising its power under Section ... acres and entire extent even
according to the appropriate Government is a gomal land and
in exercise of powers vested under Section
contend that revenue
authorities themselves have treated these lands as 'Gomal
land' and as such he contends that Tribunal committed a
serious error ... have submitted
applications seeking regularization is 'kharab land' or 'Gomal
land'. He would also contend that if an

availability of gomal land in the village is inadequate.
Heard learned counsel for the petitioner as also
favour of respondent and when
land in question being a Government land (gomal land),
purported grant certificate relied upon and claimed by
respondent being false ... Bangalore East Taluk, for
agricultural purpose, since land in question was a
gomal land reserved for free pasturage. Based on said
order, Deputy Commissioner, Bangalore
pursuant to Official
Memorandum dated 12.12.1978 issued for reducing the
extent of gomal for agricultural purposes by de-
reserving said land for said purpose
orders, 3rd respondent has passed an order
dated 22.3.2011 Annexure-E whereunder gomal land
was dereserved by Government In exercise of Its
power under Rule ... Rule 97 of
Karnataka Land Revenue Rules, 1966 has reserved
Gomal land for distribution of house sites to site-less
persons and there
bearing RS
No.202, 203, 204, 210-213, 216 and 217 are Gomal
lands reserved for grazing of cattle and cutting the grass ... dispute that revenue
records indicate the status of the land as Gomal and as
to whether the plaintiffs are in lawful possession of the
suit
