goods vehicle, and the deceased was traveling in the same as
a gratuitous passenger. In the case of goods vehicles, neither
statutory nor contractual coverage ... exists for the risk of
gratuitous passengers. Nonetheless, the Tribunal has imposed
liability on the Insurance Company.
13. Learned counsel further asserts that the complaint
accident was a goods vehicle in which the
claimant was a gratuitous passenger and the driver did not
have a valid and effective driving licence ... goods vehicle and the fact that the appellant was a
gratuitous passenger travelling in the said vehicle, the
insurance company is not liable
Tribunal came to
