proprietors of village Kungrat reserved certain area in
Shamilat land for grazing purposes and other such common purposes.
Subsequently, the village was partitioned and divided ... kanals 19 marlas which was a
shamilat land and used for grazing purposes fell in Majra Dughe. The said
pasture land was used
farsa, lathi, barchhi, axe etc. and attacked the
deceased while he was grazing his cattle in a field at village
Bhadera, causing him multiple injuries ... that on the fateful day Preetam
Singh had taken the cattle for grazing to village Bhadera which is
in a forest area at about
cultivation of singhara (water nuts), the planting of a mango grove and grazing of cattle were not held to be agricultural purposes: Battoo v. Narainprasad ... upkeep of orchards; and
(d) the preserving of land for fodder, grazing, thatching grass;"
and, in my opinion, the word 'agriculture' having
Mouza Solagaria, Circle and District Pakur,
Jharkhand, was recorded as gochar (village grazing land) for the said village
Solagaria.
3. In a public interest litigation ... 6779/2006] in the Jharkhand High Court
inter alia contending that the grazing land (gochar) could not be used for any
other purpose and seeking
been defined to mean a land used by Girasdars or Barkhalidars for
grazing cattle or for cutting grass, for the use of cattle, meaning
thereby ... agriculturist of the
land held by him or part thereof for grazing but does not
include-
i) the use of any land, whether
proposal of their Gram Panchayats to auction land reserved as
pastures/grazing grounds for the purpose of cultivation. The petitioners, in
essence, contend that ... empower a Gram Panchayat to change its user, land
reserved as grazing grounds/pastures cannot be auctioned for the purpose
of cultivation.
