that he did not
explain the meaning of charges of habitual absenteeism and habitual
late coming; that it was correct that he did not explain ... suggest that the
workman never admitted the charge of habitual absenteeism and
habitual late coming; that it was wrong to suggest that
upon the
following grounds:
(a) That the petitioner was a 'habitual late filer', with a view
to avoid scrutiny/enquiry; and
(b) There ... material nor any
justification to style the petitioner as an 'habitual late filer'. Besides, the
petitioner by its communication dated 23 March
improve his conduct and as a result of his habitual late attendance and other acts of misconducts, the work of the establishment of the Petitioners ... Respondent workman had admitted before the enquiry committee the charge of habitual late coming but the enquiry committee chose to give him further opportunity

coming/early going during the years 2004, 2005 and
2006". The workman replied ... short);
(iii) Workman has admitted charge No.2 that he
was habitual late coming and leaving the work place early
and that was sleeping while
remarks of his controlling
officer which refer to his insubordination, habitual late coming
and overall conduct not being satisfactory. The Committee
also noted the facts ... retiring Shri Satbir Singh under FR-56(j):-
(a) Insubordination
(b) Habitual Late coming
(c) Overall conduct not being satisfactory.
It is amply clear that
intervening period.
It is lastly argued that the claimant was habitual late comer. In
support, the ARM relied upon the following citations :
