Before a Court can act on the opinion evidence
of a handwriting expert two things must be proved beyond any
manner of doubt, namely ... genuineness of the
specimen/admitted handwriting of the concerned accused and
(ii) the handwriting expert is a competent, reliable and
dependable witness whose evidence inspires
illegally and created
forged receipts” and the FSL report-report of the handwriting expert
is filed in the said suit and the Civil Court ... High Court has failed to appreciate that the
opinion of the handwriting expert is relevant evidence, but it is not a
conclusive evidence and Section
opinion evidence--Conviction on the
basis solely of opinion evidence of a handwriting expert

In the case law reported as Murari ... reliable evidence
through a doubt, the uncorroborated testimony of a
handwriting expert may be accepted.‖
(xiii) Ex.DW3/P-18 letter dated
Punjab (1977) 2 SCC 210, while dealing with the
evidence of a handwriting expert, this Court opined:
“… We think it would be extremely hazardous ... condemn the
appellant merely on the strength of opinion evidence of a
handwriting expert. It is now well settled that expert opinion

obtained report dated 30.12.2002 from
Forensic Science Laboratory regarding
handwriting on various documents.
Handwriting opinion was also obtained with
regard to signatures ... opening of a savings bank
account. Investigation Agency has obtained opinion
of handwriting experts with respect to signatures
of Gautam Dhar on the account opening
cash book. The allegation that all the
vouchers were filled in his handwriting as stated by the
witnesses is not correct. They wanted to place ... witnesses as well. The investigating officer had not taken his
specimen handwriting and not sent the same for expert opinion
to compare the same with
