while deciding the
question of proper sentence. Earlier, the appellant
herein filed HMOP 515/2012 before the Family Court,
Coimbatore, seeking divorce. In the judgment ... first accused had filed a petition seeking
interim maintenance in the above HMOP and based on a
petition in that regard the Court had ordered
appellant who refused to cohabit with her. In these circumstances,
appellant filed HMOP 24/2003 on 05.03.2003 under Section ... which was later re-numbered as HMOP 10/2005. Post-trial, a decree of
divorce was granted after almost 5 years
divorce by mutual consent.
In view of this order, the proceedings being HMOP
No.111/2009 pending before the 2nd Joint Senior Civil Judge,
Gandhinagar
hence ordered a remand setting aside the Judgment and Decree
rejecting the HMOP providing a further opportunity to the parties to
adduce evidence
