vagina. The hymen was found ruptured. The clothes of the
victim worn at the time ... right cheek. According to Mr.Darji, the said certificate
states that the hymen was not torn, no marks of any injury
were found over
commission of rape. As per examination Kit
for victim of sexual abuse, hymen was found intact and the history was
inconsistent with any recent ... also correct that even in terms of medical documents on
record, the hymen of prosecutrix was found intact and there was also no
bleeding from

shows that if penetration is partial and does not
touch hymen then hymen can remain intact.
According to the learned A.P.P. even ... have been discarded only because the
medical evidence found that the hymen of the
Victim was intact.
4. Against this, the learned counsel

Again, on 16/05/2012, the prosecutrix was medically

told by patient herself and her father, on L/E : Hymen torn (no evidence
of recent fresh trauma). No evidence of any external ... Hospital. She
examined the patient and on local examination her hymen were (was)
found ruptured. Patient was not cooperative and she was referred
abdomen examination
