first time, he was allocated the portfolio of ascertaining the
"Impact Fee" in the Town Planning Scheme No. 22, Varachha

purposing of issuing notice for the impact fee under GRUDA.
That, there is no further participation of the applicant
basement area which came to be regularized upon
payment of impact fee by virtue of an order dated 16.2.2016

considering the said report, notices for
impact fee were issued by the present
applicant;

thus, totalling
application for
regularization, directed the petitioner No.1 to pay the Impact
Fees for area of 61.43 sq.mtrs. And the petitioner No.1
complied ... with the same and deposited the Impact Fees on
5.10.2016. He has submitted that despite the
regularization order dated 16.12.2016, to the utter shock
members in
the society have raised additional construction and their impact
fee has been accepted while regularizing the construction. The
petitioner is also ready ... willing to pay said impact fee
including the penalty if his construction is allowed to be
regularized. In any case, without much entering into merit
planned and as per they have
charged while taking impact fees with
the petitioner association and from
its members."
2. I have heard ... with
respect to the collection of Rs.45 Lacs as impact
fees and thereafter have not done anything in that
respect and instead started
