permit or certificate or authorization etc. in relation to
"imports into or exports from India" the contraband material.
7.5 It cannot be disputed ... petitioner pointed out that the petitioner is possessing
Certificate of Importer-Exporter Code issued by Government of
India, Ministry of Commerce on 27.11.2003 and thus
appellants were charged under Section 409 IPC
and Section 5 of the Prevention of Corruption Act, 1947 for making
false panchnama disclosing recovery ... Section 23(1A) of FERA and Section 5 of
Import and Export (Control) Act, 1947. The appellants filed an
application before the Judicial Magistrate
further stated in the Report that instead
of exporting finished products, the Company had
exported livestock such as buffaloes, goats, sheep and
consequently a complaint ... under Section 5 of the Imports and Exports
(Control) Act, 1947 and Section 120(B) of the Indian
Penal Code read with Sections

3.3 The accused company had exported a consignment
and along with export documents, certificate ... export
was Australia and the importing entity from Australia,
when cross verified, it came to surface that the
certificate of fumigation accompanying the export

Section 65 more particularly clause (a) thereof; which
punishes the import or export of intoxicant; in the facts of the present
case the intoxicant worth ... with no option but to exercise the discretion under Section 438 of
Cr.P.C in favour of the petitioner. Accordingly the petitioner is admitted
