petitioner was duly sanctioned two
incentive increment by the department as per G.O.Ms.No.42 dated
10.01.1969. On 05.12.2006, petitioner was sanctioned increment ... attained superannuation on 31.05.2013.
2. After 14 years of sanctioning of incentive increment, the 2nd
respondent had raised audit objection on 06.05.2010 by stating that
degree and passed.
Pursuant to the same, respondents herein have awarded incentive increments
for M.A., and B.Ed., degree. However, by virtue ... impugned order of the
second respondent, cancelled the incentive increments granted to the petitioner
that petitioner did simultaneous degree and directed to recover the excess
incentive for B.Ed. along with
M.A. and for having completed M.Phil, the petitioner is entitled for one more
incentive increment.
2.2. Prior ... second incentive for having completed his
M.Phil., degree, however, till date the petitioner's request for grant of the
second incentive increment
degree, BLIS and MLIS degrees. Accordingly, the
petitioner was provided with incentive increments for acquiring higher
qualifications. However the second respondent / District Library Officer ... incentives were granted for more than
five years, this Court is issuing the following directions insofar as recovery is
concerned:-
i) if the incentive increment
obtained M.A and M.Phil degree and applied for incentive
increments, stating that she has obtained additional qualifications. Accordingly,
she was provided with incentive ... increments. The Department has now ordered for
recovering the incentive increments holding that the petitioner is not eligible for
any incentive increment
