and therefore, the present interpleader suit has been filed to seek the leave
of the court to seek indemnity ... reproduced here as under for ready reference:-
"88. where interpleader suit may be instituted - Where

An interpleader suit has been filed by the plaintiff
as developer against the intending purchaser ... obligations imposed under the aforesaid Clauses. The
plaintiff/appellant filed the interpleader suit seeking
various reliefs including the relief in the form of
discharging
owner of the premises, he is
supposed to file an interpleader suit
impleading all the legal heirs of the deceased
and ask the Court ... landlord/owner after the death of the
original owner. Where no interpleader suit is
filed by the tenant and the tenant continues in
possession after
owner of the premises, he is
supposed to file an interpleader suit

3. The interim application has been taken ... suit, the former is
the better option. This upon considering that the
commercial suit was filed by way of interpleader suit and
