1) The appellant before us joined the respondent-company on 19th
October, 2009 pursuant to a letter ... respondent; retention
amount of Rs.10 lakhs as well as the joining bonus of Rs.30 lakhs in two
instalments of Rs.15 lakhs each

The said bonus was not payable to all the workmen at
the time of joining the employment. It was payable ... minimum wage from the
very first day of his joining the employment whereas
the bonus has to be earned and it becomes payable
"after
which would throw an additional financial burden on the management, other
than bonus. Of course the proviso to that clause exempted matters covered under
Section ... paid a larger amount by way of salary, bonus and gratuity than
workmen who may newly join in place of retiring men". The High

the workman at the time of joining the duties of the management, the

joining the duties of the respondent/management
also assured that he would paid bonus, gratuity,
PF etc. The management no.1 (herein after called M1) transferred
to the workman management ... herein after called M2) on
10.03.03 and workman joined the duty in the office of management
no.2 on the monthly salary
management, workman was not entitled to
receive the benefits (i.e. ESI, bonus, overtime payment etc.) Management has also
denied the averments of the workman ... suggest that he joined the management on 22.04.2006, in as much as,
workman claimed bonus for the year 22.04.2006 to 25.06.2010. However, in the
demand
management till 12.11.2010 and on 13.11.2010, when the
petitioner/workman went to join his duty, the respondent/management
misbehaved with the petitioner/workman ... amount of overtime, bonus, dues, leave cash, gratuity etc.;
that the workman was not allowed to join his duties in spite of his
repeated requests
