Judge, Chandigarh to give a finding whether the acceptance of kickbacks
was a part of discharge of official duty or not and for that ... along
with some other officials of Engineering Department, U.T., Chandigarh
accepted kickbacks while discharging his official duty and the question was
whether acceptance
after illegally obtaining their payments paid back
some amounts by way of kickbacks to Anuj Gureja and Mr. Gaurav Sehgal.
The latter after receiving ... kickback amount from the vendors used to
make payments to then serving employees namely Vivek Jaiswal, Sachin
Saxena, Kamal Jain and Neeraj Bhatia.
Along with
award contracts to different foreign bidders with the
motive of getting illegal kickbacks from them. An
account of such receipts and payments was
maintained
with respect to an amount of Rs.1437 crores but the kickback amount
was of Rs.64 crores. It is submitted that in the present
Court.
The charge was not one of corruption or receiving kickbacks it was of
purchasing kitchen equipment from un-approved sources on higher prices

Rs.64 crores. Thus, the said conditions cannot ipso facto
forged documents as genuine and some of the
government official(s) receiving kickbacks in return.
