HEARING, THIS DAY, KRISHNA S. DIXIT.J., MADE THE
FOLLOWING:
ORDER
The KPSC is grieving before this Court against the
Tribunal's Order dated ... conduct of the Petitioner herein having been
found faulty, it directed the KPSC to call the Private
Respondent for interview for the post of Assistant
inasmuch as the
penalty order was made consistent with the
recommendation of KPSC; that Rule 214(1)(a) of
Karnataka Civil Services Rules, 1958, empowers ... more order of punishment superadding to the same,
merely because the KPSC had recommended. There is
nothing in the text of Rule
issued the appointment
order, following the selection process done by the KPSC.

6. The contentions that the KPSC is only a
Selection Body and therefore, it has no discretion to relax
the conditions ... accordingly,

(i) The Petitioner KPSC shall process the matter
and submit the file to the Government within
four weeks

having resorted to such an exercise. The petitioner-KPSC
itself had sent the candidates for second test by writing as
under:

costs having been reluctantly made easy.
The petitioner-KPSC shall process the matter and
forward the File to the 2nd respondent within three
consolidated manner or which is to
be consolidated at the KPSC end based on the
various categories in various districts for which
selection is sought ... untenable and a negation of the
principle of merit by the respondent KPSC."
We are broadly in agreement with the above observations
