Procedure
which is under challenge in this appeal.
2. Vide registered lease deed dated 13th May, 2002, the
respondent let out the suit property ... aforesaid lease was renewed for a
further period of two years at a monthly rent of `15,000/- per
month. The lease deed dated
long term lease in respect of two Tea estates (Chandmari Tea Estate and

Burahapahar Tea Estate). A lease deed dated 21.12.2006 was executed
between ... granting the lease for 30 years then it would be for enforcement of the terms
of the lease deed which is impermissible under section
reads as follows:
"15. LEASE OF PLOT:
a) Lease period:
i) The SHCL shall enter into a Lease Deed on
completion of project period ... till the end of lease period, this Contract
Agreement is to be read, in conjunction with the
said Lease Deed which both Parties will enter
landlord and tenants between the parties

Therefore, it clearly stipulates that this lease deed has been executed
lease. The
default clause is pressed into service to destroy the main
term of the lease. Under el. 1 of the lease deed ... lessor was
getting under the lease after 1950, i.e., after the
execution of the lease deed, viz., the total of the
instalments of premium
