deny the
issuance of cheque and further, the petitioner herself admitted that she
used to sign the cheque leafs and leave it with her husband ... petitioner lodged a complaint stating about
misplacement of her signed cheque leaf and other documents before the
Inspector of Police, R10, MGR Police Station
time of issuance of the alleged
cheque, he was not in India, but abroad, and the cheque had been misused.
Hence ... avoid facing perjury charges, the petitioner claims that the cheque
has been lost.
6. Pursuant to the complaint and FIR in Crime
take into
consideration that in the year 2015, the petitioner lost his cheque (Ex.P1) and
reported the same to his banker Karur Vysya ... facts. The respondent's contention that the cheque
(Ex.P1) was filled up, signed and handed over by the petitioner would
back the money with 5% interest and also he gave
post dated cheque drawn on Indian Overseas Bank, Mylapore Branch.
On the contrary ... make the payment. Further, the 4th respondent forcibly took the blank
cheque signed by his wife, drawn on Bank of India, Mylapore Branch,
Chennai
believing A7 had signed in all the documents given to him.
Signatures obtained in blank cheque book and RTGS vouchers, which were
used to transfer ... thereby got enriched and ultimately
the public money has been cheated and lost thereby the accused have made
unlawful gain.
