10. As on date, from ... posts of PH category 2 are vacant. Shri Jagdish
Soni with Low-Vision disability is the only PH candidate on the cadre
which defines
disabilities reads as follows:-
"(i) "disability" means-
(i) blindness;
(ii) low vision;
(iii) leprosy-cured;
(iv) hearing impairment;
(v) locomotor ... teachers
have been included to be suitable for disabled persons with disability of
blindness and low vision apart from others.

where specified disability has been defined ... low vision disabled person, automatically, it would be
transferred to other disability persons like the petitioner, who is having
the locomotor disability and in that

persons with disabilities as those having not less than 40% disabilities
and identified 7 categories of disabilities viz. blindness, low vision,
hearing impairment, locomotor ... similar disabilities. For
disabilities relating to vision, 1% reservation is made. For disability
relating to hearing, 1% reservation is made. For Locomotor disability,
1% reservation

recruitment of Civil Judges ... belongs to Scheduled Tribe
category and although has a blind and low vision

and identified 7 categories of disabilities viz. blindness, low vision,
hearing impairment, locomotor ... similar disabilities. For
disabilities relating to vision, 1% reservation is made. For disability
relating to hearing, 1% reservation is made. For Locomotor disability,
1% reservation

2(ii) The petitioner was suffering from 40% low vision
disability. He satisfied the eligibility criteria stipulated ... vision subtending an
angle of 20 degree or worse;"
Section 2(u) defines low vision as:-
"person with low vision" means
Alwar in 2nd year B.A. (Arts) and is suffering Vision from Low vision
disability.
2.1 The respondent No. 2 had published an Advertisement ... with benchmark permanent disabilities and not for any
temporary disabilities, so the applicant, who is having temporary
disability in low vision is not eligible
reservation for persons with disability in the posts
identified for three categories of disabilities namely (i) blindness
or low vision, (ii) hearing impairment ... with benchmark
disability, of which 1% each shall be of all posts reserved for
persons with following disabilities:-
i) blindness & low vision (with reservation
