reason for not bringing on record the matriculation
certificate or school record of the victim and same lends
substance to the contention of Ld counsel ... time of incident and same
would have been substantiated by her school
record/matriculation certificate. Mother of the Victim has not
been examined
obtaining :-
(i) the date of birth certificate from the school, or the
matriculation or equivalent certificate from the concerned examination
Board, if available ... school leaving certificate

3654, this Court has opined that,
"An admission in the School register cannot have
the finality for the purpose of determination ... Corporation
or Municipal authority or birth certificate from a School First
attended or Matriculation or Equivalent certificate if available.
When the documents which are relied
obtaining:-
(i) the date of birth certificate from the school, or
the matriculation or equivalent certificate from the
concerned examination Board, if available ... provides for giving preference to
documentary evidence from the school and birth certificate
given by a Corporation or a Municipal Authority or a Panchayat
certificate from the school first

school stated that the prosecutrix ... play school or a Madarsa at the village, the same was irrelevant, for the
reason, the school first attended other than the play school
