petitioner who while submitting application for Punjab Open
School Matriculation Course Annual Exam, 2008 has submitted his date of
birth as 14.1.1989. The said application ... submitted that the form submitted
by the petitioner before Punjab Open School Matriculation Course Annual
Exam, 2008 and the affidavit furnished by the father
reason for not bringing on record the matriculation
certificate or school record of the victim and same lends
substance to the contention of Ld counsel ... time of incident and same
would have been substantiated by her school
record/matriculation certificate. Mother of the Victim has not
been examined
obtaining :-
(i) the date of birth certificate from the school, or the
matriculation or equivalent certificate from the concerned examination
Board, if available ... school leaving certificate
dated 31.03.2011. A copy of the admission and withdrawal register, a
certificate issued by the school and 10th class matriculation certificate
birth certificate from the school first attended other than a
play school. Only in the absence of matriculation or
equivalent certificate or the date ... forwarded by the Head Master of the Secondary
School. The Head Master of the said school had deposed that the date
of birth
investigation copy of
birth certificate was also taken from the school. On 01.05.2019,
petitioner surrendered in the court and after interrogation he was
arrested ... considered is Date of Birth Certificate

[ii]a date of birth certificate from the school first attended ; or
[iii]matriculation or equivalent certificates, if available ; and
[iv]in the absence ... earlier PW 10 had deposed that the
victim was admitted in the School on 12.06.2002 in Class 6 and that the
victim studied
should be sought only when
matriculation certificate or equivalent certificate or the date of
birth certificate from the school first attended or any birth
certificate ... into. If a
Matriculation certificate is not available then date of birth as mentioned
in the birth certificate from the school first attended
whereof;
(ii) The date of birth certificate from the school
(other than a play school) first attended;
and in the absence whereof;
(iii) The birth ... provided either a matriculation/equivalent certificate

(when it could have easily produced the same) or the
certificate from the school where the victim first
obtaining --
i. the date of birth certificate from the school, or the matriculation or equivalent certificate from the concerned examination Board, if available

attended other than a play school. PW-5 who appeared with the record of the
school stated that the prosecutrix ... play school or a Madarsa at the village, the same was irrelevant, for the
reason, the school first attended other than the play school
