Order XIII Rule 1:- Original documents to be produced at or before ... other party; or
(b) handed over to a witness merely to refresh his memory.
Sub Rule (1) of Rule 1A of Order VIII mandates
when it is to be used for cross- examination or to refresh memory of the witness.
The aforesaid contention of learned counsel for the revisionist
statement of Inspector of police who was legally entitled to refresh his memory in the court at the time of making the statement wherein specific
trial to prove the injuries of the injured person. He could refresh his memory under Section 159 , Evidence Act by referring to the injury report
