relied upon and the panch witness after he
had refreshed the memory and supported the case of the
prosecution. That in the entire evidence ... permission of the learned trial
Court, the witness was allowed to refresh his memory and the
panchnama was shown to him and the witnesses thereafter
witnesses, or
(b) handed over to a witness merely to refresh
his memory.]
9. As per sub rule 1 of Rule 1A of Order ... witnesses, or

Subrule (1) mandates the defendant to produce
the documents
Witness No.19 is a Police Officer, who at best can
refresh his memory while giving deposition before the Court as stated in
Section ... paragraph no.4 of the impugned order. The said act of refreshing memory
is with regard to the steps taken by him during the course
witnesses, or, handed over to a

That there is a shed outside of the Mandvi Police Station
panchnama on that day. The witness was permitted
to refresh his memory and the panchnama was read over to
him and thereafter, the witness
able to recollect or the bank is in a position to refresh the memory.
It has also been held and observed that the inbuilt mechanism
said witness was aided by the learned Public
Prosecutor by refreshing his memory by reading contents of
panchnama with regard to the conduct of trap
