37(4) to 37(6) of MEPS Rules while conducting the inquiry

committee to have observed rule 37(4) to rule 37(6) after

Maharashtra Employees of Private Schools (Conditions of
Service) Regulation Act, 1977 and Rules framed thereunder

11. A perusal of the aforesaid Rule of MEPS, shows that all the
employees of the teaching staff are entitled
pursuant to the interpretation of Rule 41 of Maharashtra Employees of
Private Schools Rules, 1981 (for short, "MEPS Rules"), which deals
with transfer ... passing the impugned order contrary to the provisions of
Rule 41 of the MEPS Rules and the above referred judgment.
