Facts of case, in nutshell, are that father of petitioner migrated
from State of Maharashtra to erstwhile State of Madhya

migrated on account of reorganization of State has held that
person migrated
clarifying that the Scheduled Caste and Scheduled Tribe persons who have migrated from his/her State of origin to some other State for the purpose ... origin and not from the State to which he/she has migrated.
4. In reply to the above said facts and contentions raised
therefore, a person belonging to scheduled
caste category could not have migrated to the unreserved Category list to
occupy a seat meant for unreserved Category ... more meritorious will find place in the

candidates, horizontal reservation is to be accorded
improper selection procedure adopted by the respondents and hence, he sought for migration/transfer to any one of Government Dental Colleges.
