" Section 17 Misbranded drugs: For the purposes of this Chapter, a
drug shall be deemed to be misbranded ... manufacturer of whom it

17C. Misbranded cosmetics: For the purposes of this Chapter, a
cosmetic shall be deemed

Nahan and concluded that impugned drug product is
deemed as misbranded as per Section 17 of the Act. M/s Therawin
Formulations was intimated through ... noticed by the petitioners. Therefore,
petitioners have no role in either misbranding or in manufacturing
