While the petitioner nos.2 to 6 are children of the missing
employee, the petitioner no.1 is stated to be lawful guardian

5. Per contra, the learned Senior Counsel for the
respondent/employee would rely on the another ruling of
the Apex Court in Rajinder ... this is
gainful employment, the employer can contend
that the dis-missed employee in order to keep his
body and soul together had taken
Station on 19.03.1994 but no action was taken to find the missing employee. Subsequently, a paper publication had also been effected on 16th January ... legal heir is none other than the wife of the missed employee, who is entitled to get all the terminal and other benefits

the instance of the widow of an erstwhile
employee of the Kolkata Municipal
Corporation.
Having heard the learned Advocate
appearing ... from KMC shall
be refunded to KMC in the event
the missing employee/pensioner
re-appears and claims his dues.
