retired from the job on 01.05.1982. That
Sh. Krishan Lal Gulati went missing from his home at 4:00 pm
on 25.02.1989 and accordingly ... that after Sh. Krishan Lal Gulati had gone missing, his pension
was released in favour of Smt. Oma Wanti. In these
circumstances, a presumption
after that his service benefits like pension etc were given to
the missing person as per rules of the Department of the
defendant ... vide Pension Payment Order
029/19374/PAO/DLI. The missing person was operating a saving
account with the defendant no. 5 vide account
release her outstanding pensioner benefit i.e.
family pension at enhanced rate vide her letter dated 08.08.2011
received through Dy. Manager (Pension) MTNL vide letter ... recovered the family pension from pension Department of Sh.
Om Parkash Sinsinwar since 2007, & also has got the arrears of
pension
husband made a call to her and asked
her to check the missing articles of the house. Witness has further
deposed that she checked ... pension money of her mother was missing
on which she informed her husband immediately about these missing
items. Witness has further deposed that
concerned department to release
the service benefits/ pension of Shri Diwan Chand for the
missing period since 01.07.2014 onwards.
4. Summons of the present suit ... admitted to have not given
letter to MCD regarding missing of deceased or release of
pension. She also admitted to not place on record
employment
notice in the
newspaper in Times of India dated 16.06.2012 regarding the
missing of Shri Ashok Kumar Singh but the concerned police ... family pension and other consequential
service benefits could not be released to the plaintiff no.1. Since
Shri Ashok Kumar Singh had been missing
scattered. On search, mobile phone, ration
card, election card and pension card were found missing.
He also deposed that silver hasli and silver kadule
releasing the pension of Plaintiff No. 1
but Defendant No. 2 has always asked to submit Death
Certificate of the missing person namely Shri Mukesh ... submit the
Death Certificate of the said missing person to enable them to
release the pension to Plaintiff No. 2. Plaintiffs have further
denied suit
