Judge, the four
sons of Late Birendra Nath Basu, applied for mutation to DDA in
respect of the said 1/4th share ... said 1/4 th share of deceased
Birendra Nath Basu was mutated by DDA in favour of
his four sons;
(vii) On 21.5.2009 a Conveyance
remained
unchallenged and unrebutted. PW2 Rajbeer Singh, Patwari
from the DDA proved mutation of the said properties in the
name of the respondents and other ... clearly
stated in his evidence that the said mutation was done by the
DDA based on inheritance. The testimony of PW2 also
remained unchallenged. This
very much there and his father had died intestate.
By this mutation DDA acknowledged him as the sole proprietor of the property,
however ... charge of cheating.
Mutation may not be a proof of title in certain circumstances, but, mutation of
leasehold property registered with DDA
Shri Shyam Shankar Goela, applied on
30th April, 2007 to the DDA for mutation of the property in question in their ... shall deposit the amount, demanded by the DDA, within two
weeks. DDA shall carry out the necessary mutation within a
period of four weeks thereafter

9. It is however the case of the respondent DDA that the respondent
DDA had in response to the letter dated 21st February ... petitioner for some
further documents to enable the respondent DDA to carry out mutation in

know that the defendant had
fraudulently got the flat mutated in his name from DDA by
concealing the very important fact that his father ... know that the defendant
had got the flat fraudulently mutated in his name from DDA. It also
arose when the legal demand notice dated

as in the record of DDA vide Mutation order Ex. PW1/7A. The
defendant during crossexamination has admitted that in DDA record ... mutation letter Ex. PW1/8 from MCD. He
further stated that he has not challenged the mutation order passed by
the DDA
Devi on
6.8.1994.
8.On 20.5.2004 the respondent applied to the DDA
for mutation of the property in favour of the legal
heirs ... Court on 17.8.2007 and the demand of misuser
charges raised by the DDA, by its letter dated
20.5.2004, was quashed.
9.The DDA filed Letters
been placed on record by the Objector.
The aforesaid property was mutated by DDA in the name of
Shri Deepak Sharma vide letter dated 26th
that the defendant no.1 had
got his name mutated in the records of the DDA on the basis of a will
allegedly left ... also
noted that it is an admitted position that DDA has cancelled the
mutation in the name of defendant no.1 and, consequently, the
conveyance
