On 10.10.1968 Ganga died. On his death proceedings
regarding mutation of the lands were initiated. Respondent
No 1. sought mutation ... basis of the
will, whereas the appellant as the nearest heir claimed
mutation in her favour.
The mutation was sanctioned in favour of the appellant
land. Rulia Singh, the adopted son of Hira Singh questioned
the mutation as well as possession of Har Kaur and, therefore, she
filed a suit ... Court and the land including the share of the
Jagjit Singh was mutated in the revenue records in the name of Rulia
Singh

The mere fact of the mutation entry being made in favour of
the respondent on the death
code was not issued; and
(e) On the above mentioned grounds the mutation entry was sought to be
cancelled.
The Deputy Collector issued another notice ... question was of the appellant. It was decided that the revenue mutation entry No.
1950 as recorded in village form no. 6 was legal
based on the enquiry
and evidence produced before him. In this mutation
proceeding which led to the mutation viz., Ex. P8, Narain
Dass, Bhagat ... records against which a matter was pending before Deori
Mualla in the mutation proceedings. Based on the evidence,
the Revenue Officer after enquiry recorded
said Kahla
Singh were arrayed as defendants.
5. An order of mutation was thereafter passed in their favour which,
however, is said to have been ... order of the Court was
regarding possession. Whereas the revenue
officials vide mutation No.38144 has changed the

took possession of the
properties and on August 24, 1920, obtained a mutation of
the settlement records showing her as the owner of the lands ... made a gift of the
entire lands to K who obtained a mutation of the settlement
records showing her as the owner of the lands
year 1988 and
on or about February 15, 1990 they applied for mutation of
the land in their names. Even after purchase of the land ... stated that it was on September 7, 1995 that a certificate
of mutation had been issued by the prescribed authority

under Act, 1954 and their names were mutated ... Maman Singh in favour of the respondents herein and their names
were mutated on 31st May, 1989, the appellants had come into
possession over
purpose of getting the estate left behind by their father mutated
in their names. Reposing complete trust in her step brothers, the

Accordingly, the plaintiff visited the village and stayed there for 3
or 4 days
