has dismissed the revision petition filed by the appellant against an
order dated 16.05.2016 passed ... costs of litigation.
3. The learned NCDRC relied upon the judgment of this Court reported
as Lucknow Development Authority v. M.K. Gupta4 to hold
order passed by the National Consumer Disputes
Redressal Commission (in short, “NCDRC”) dated
10.01.2008, whereby an order of the Himachal Pradesh
Consumer Disputes Redressal Commission ... before fastening
any liability under that Act on the
carriers.”
The NCDRC has held that since the complaint was
filed before the State Consumer Commission
interest. Still further,
National Consumer Disputes Redressal Commission (NCDRC) has ordered
that the tax at source should not be deducted.
Learned counsel for the respondents ... view of this Court is that the interest can be
granted by NCDRC @ 9% p.a. from the date of deposit till the
refund. Such
operation of the order passed by the
National Consumer Disputes Redressal Commission (NCDRC) shall
remain stayed.
