TNPCB, showed us various provisions of the Water Act,
Air Act, and the NGT Act and argued that the six impugned orders
before the NGT ... also argued, based on the scheme

of the Water Act, Air Act, and NGT Act, that all the appeals filed before
the NGT were
National Green Tribunal Act,
2010 (for short 'the NGT Act ') and there is no sufficient
cause shown by the applicant for not filing ... within the prescribed period of limitation under Section 16
of the NGT Act.

the judgment and order dated 07.05.2015 and 04.05.2016 respectively
passed by the Principal ... entertain and decide the application under
the provisions of the NGT Act, 2010 ?
3. Whether the present application is barred by the principle
said Act, which includes The Air (Prevention and
Control of Pollution) Act, 1981 and the Environment Protection Act,
1986 .
38. In view of the definition ... implementation of the 1981 Act and the
Environment Protection Act and, in particular, Section 20 of the
1981 Act which casts on the State Government
authority under either the Water Act or the Air Act ,
any direct appeal against an original order to the NGT would
be incompetent. NGT ... clearly outside its statutory powers conferred by the Water
Act, the Air Act, and the NGT Act, would be an order passed
without jurisdiction
