that he did not even
recognize O.P. No. 2 and the Nikahnama, if any, being produced,
is forged and fabricated ... between the parties. O.P. No. 2, the Maulivi
has suggested that Nikahnama was performed at Saif Alam‟s
door who has been examined
Alam. In support of
its submission, a typed translated copy of the Nikahnama
has been annexed as Annexure 2. At the time of hearing,
learned ... counsel had produced the original copy of
Nikahnama.
Upon such submission, provisional anticipatory
bail was granted to the petitioner and notice was issued to

this fact before the learned Family Court, the
applicant-petitioner produced a Nikahnama i.e. Exhibit P-1 and
also examined one witness ... impugned order clearly shows that
to prove the Nikahnama Exhibit P-1, petitioner did not examine
the author of the said Nikahnama nor any witness
last ten years and there was an assurance of
'Nikahnama' which led to physical relationship between them.

21.03.2022.

hand submits that the document clearly shows that a 'nikahnama'
took place and now for want of money, they are refusing ... complainant to provide any additional document/proof/photograph
beside the nikahnama to show that the nikah between the
petitioner and the complainant took place. Learned
complainant and she was forced by the villagers to perform
Nikahnama and as such he denied the factum of the marriage
and consequential allegation ... learned counsel for the
O.P.no.2 -complainant is that Nikahnama was performed in the
year 2017 and he never filed any complaint before
further submitted that the complainant is not even
knowing the date of Nikahnama as she has disclosed the date of
Nikahnama as 28.05.2017 whereas ... rape case the petitioner induced the complainant to enter into
Nikahnama which she did in presence of the Panchas. A paper
was also created
have since solemnized marriage
as evident from the Nikahnama dated 25.03.2019 (Annexure-3).
A compromise petition has also been filed by the parties ... concerned.
