6.11. Accordingly, the present suit along with an application for interim
injunction has been filed against the defendant.
CASE SET UP IN THE WRITTEN ... plaintiff's design
was neither new nor original and hence, interim injunction was refused. The
relevant observations of the Court are set out below
particularly, when the plaintiff's
suit contemplated urgent interim relief for ad-interim
injunction against the defendants, there was no requirement
of the plaintiff ... urgent interim relief and
dismissed the application filed by the petitioner only on the ground
that in intellectual property cases, relief of interim injunction
present suit has been filed along with the present
application seeking interim injunction.
