scale relevant for the post of Asst. Enforcement
Officer, by granting notional increments by treating him as if
he was continuously in employment, which ... orders that the first
increment will be drawn earlier before completing the
normal incremental period of 12 months. Increment will
be payable from the first
therefore, sanction was accorded by the Government to give due notional increment and revise the pensionary benefits. Since the petitioner was not in actual service
difference in the
scale of pay and on account of notional increments are
not payable and such persons shall be paid salary ... from the date of judgment only by taking into
account the notional increments.”
11. Pursuant to the order of the Division Bench of this Court
direction that the employee shall be entitled to the benefit of the increments earned during the period of absence. In our opinion, the employee after ... guilty of unauthorised absence from duty cannot claim the benefit of increments notionally earned during the period of unauthorised absence in the absence

arrived at by increasing his pay in respect of the lower
post by one increment, at the stage at which ... which stagnation increment is
admissible and where the pay plus notional increment in
the lower post exceeds the maximum of the time-scale
calculated from the date of joining the service.
iii) The notional Pay increment to be calculated from date of
intended regularization.
iv) However ... reasons for granting the Time Scale of pay
and notional Pay increments in this aspect arrears cannot be granted.
The Notional Pay increment granted
Accordingly to the respondents the petitioners are entitled to only one notional increment vide G.O.Ms No.590 Finance (pay cell) Department dated
cadre of Executive Officer Grade-I as on 2.2.1969 and notional increments ought to have been allowed and that the petitioner is also entitled
their actual joining of duty in the promoted post,
reckoning the notional increments due from the dates of their
notional appointment
calculated from the date of joining the
service.
iii) The notional Pay increment to be calculated from date
of intended regularization.
iv) However ... reasons for granting the Time Scale of
pay and notional Pay increments in this aspect arrears
cannot be granted. The Notional Pay increment granted
