the said monthly contributions ... respective GPF account from the amount
accumulated in his existing NPS account.
e. Pass any order/relief/direction(s) as this Hon‟ble
Tribunal

Pension Scheme [for short NPS] and there is delay of more
than 20 years in challenging the impugned orders dated ... whereby option for switch over
from NPS to OPS was sought pursuant to OM dated

been implemented, such personnels ought to be granted the

OPS.

Rules in place of NPS of those Central Govt. employees who are
recruited against the vacancy posts advertized/notified ... advertized/notified for recruitment/appointment prior to the
date of notification for NPS i.e. 22.12.2003 and is covered under
NPS on joining
January 2005.
7. By that time even though the New Pension Scheme (NPS)
was announced by the Government and it was to take effect ... those who joined on or after 01.01.2004, the orders to
implement the NPS in EPFO were still not issued. The
implementation of NPS in EPFO
Ministry of Finance, vide
notification dated 22.12.2003 introduced the National Pension Scheme
(NPS) for all government servants appointed on or after 01.01.2004.
2.2 The advertisement ... before 31.12.2003
against vacancies occurring before 01.01.2004 and are covered under
NPS on joining service on or after 01.01.2004. The OM provides for
giving
legal right for coverage under Central Civil Services (Pension)
Rules instead of NPS though appointed after 01.01.2004 against
posts or vacancies notified-released for recruitment ... prior to
22.11.2003, the date of notification for NPS or 01.01.2004 but the
advertisement published after 01.01.2004?
