19.Rule 18 of the LMPC Rules comes under Chapter II of the
LMPC Rules which
known as
Legal Metrology Act, 2009 and the Legal Metrology (Packaged
Commodities) Rules, 2011. It is their case that for the purpose
of convenience ... packed commodities, had found that pre-packages
were not according to the provisions of the Act and the Rules
and therefore, the proceedings had been
provisions of the Legal Metrology Act 2009 and Legal
Metrology (Packaged Commodities) Rules 2011, are not
applicable to the subject goods and quash the impugned ... only "industrial consumers" as defined under Rule 3 of
Legal metrology (Packaged Commodities) Rules,
2011. Thus, according to the petitioners, the notice
notice wherein it was pleaded that Rule 9 (1)
(b) of the Legal Metrology (Packaged Commodities) Rules, 2011 (for short 'the
Rules') made ... printed or graphic matter affixed to, or appearing upon any pre-packaged
commodity.
Rule 9 (1) of the Rules reads as under:
