Contempt of Courts Act 1977, Sections 5 , 13-Fair comments-
Publication of pamphlet by an Advocate imputing motives to a
Magistrate-Tests to judge ... revision in the High Court expired, the
appellant published a pamphlet. In the pamphlet imputations
of improper motive to the learned Magistrate in deciding
publication on March 22, 1987, a day prior to
the election, pamphlets containing a news item in daily
"Malayala Manorama" dated ... judgment.
Allowing the appeal, this court,
HELD: 1.1. As regards the pamphlets, the first respond-
ent in his election petition had relied upon an innuendo
meaning thereby
