3. This being so, the respondent issued notice under
para 26B of the Employees' Provident Funds Scheme, 1952
("EPF Scheme ... examine the employer
and employee relationship, an enquiry under para 26B of
the EPF Scheme, 1952 was initiated, and on enquiry, vide
impugned order
determine such disputed matters, the Scheme provides a particular procedure para 26B provides :
"26B. Resolution of doubts. - If any question arises whether an employee ... decided only after notice to the concerned watchman as required under para 26B of the Scheme.
11. With the above conclusion, I should have remitted
para 31 of the judgment thus :
"The leading case for a long time was Pigot's case, (1614) 11 Co Rep 26b where ... doctrine of Pigot's case (1614) 11 Co Rep 26b or the authority cited for it; and not being bound, we are certainly
passed by the respondent in exercise of its
power contained under para 26(B) of The Employees'
Provident Funds Scheme, 1952.
